Intellectual Property Policy
Last updated:
Jersa exists because we love the look of old sports kit: the thick stripes on a rink sweater, the pinstripes on a ballpark button-front, the wide arm holes of a court tank. What we do not do is borrow anyone’s name or badge to sell it. This policy explains what belongs to Jersa, how you may use it, what you may and may not ask us to print, and how a rights holder can tell us about a trademark, design, publicity or other intellectual property concern. Copyright notices have their own step-by-step page at DMCA.
At a glance
- Every Jersa design uses our own decade-inspired colourways. We carry no team, league, college, club, player or brand names or logos, and nothing we sell is presented as affiliated with any sports organisation.
- Personalisation fields are for your own words only: your name, nickname, family name or number.
- We refuse text that is a team, league, college, player or brand name, a logo description, a trademarked slogan or anything else that belongs to someone else.
- Rights holders can report concerns to support@jersa.shop with the subject “IP concern”. We reply within 24 hours on business days.
- Our own designs, photos and text may be linked to, not copied.
1. The idea behind our designs
Sports clothing from the 1970s, 80s and 90s has a recognisable language: contrast yokes, tail stripes, two-colour numbers, ringer collars, raglan sleeves. Those general features are part of a shared visual history and nobody owns them. Specific team identities are a different thing. A club’s name, crest, mascot, wordmark and, in some cases, its distinctive colour scheme are protected brand assets, and we stay well clear of them.
So each Jersa piece starts with a mood rather than a club. A sunset orange and chocolate brown hockey sweater that feels like a Saturday afternoon rink in the late seventies. A teal and cream basketball tank that feels like a nineties summer league. A powder blue baseball pullover with navy piping. We choose and name these colourways ourselves. If one happens to resemble a combination you associate with a particular club, the resemblance is to an era, not a claim that we are connected with that club. If you are a rights holder and you think a colourway goes further than that, section 7 tells you how to raise it.
2. What belongs to Jersa
The Jersa name, our logo, the colourway artwork across our throwback hockey jerseys, retro basketball jerseys, retro football jerseys, vintage baseball jerseys and retro tees and hoodies, our product photos and digital previews, product descriptions, guides, page layout and site code are owned by Jersa or used with permission. They are protected by copyright, trademark and other laws.
2.1 What you are welcome to do
- Browse, save and print pages for your own personal use.
- Share links to products and pages with friends, in group chats or on social media.
- Post photos of a Jersa piece you bought and are wearing.
- Quote a short passage from a guide with a link back to the page it came from.
2.2 What needs our written permission
- Copying our product photos, previews or descriptions onto another shop, marketplace listing or print-on-demand account.
- Recreating our colourway artwork to sell, or making products derived from it.
- Using the Jersa name or logo, or anything confusingly similar, in a way that suggests you are us or work with us.
- Bulk-downloading the site with scrapers or bots. Normal search engine indexing is fine.
3. The personalisation rule: your own words only
Custom products have three fields at most. Name on back is required and allows up to 12 characters. Number on back is required and allows 0 to 99. Some styles add an optional Front word of up to 10 characters. Personalisation is included in the price, and a live preview shows your text on the product image.
Those fields exist so the jersey can be yours. They are not a way to turn a Jersa colourway into someone else’s kit. By submitting text, you confirm that it is your own words and that you have the right to have it printed.
3.1 Text we are happy to print
- Your first name, last name, nickname or initials, for example “OKAFOR”, “BIG JO” or “T.R.”
- A family or friend group name for a matching set, such as a reunion or a bachelor weekend.
- Your own beer-league or pick-up team name that you made up, as long as it is not a professional, college or brand name.
- A number with meaning to you: a birth year’s last two digits, an anniversary, the number you wore as a kid.
- An everyday word on the front, like “GRANDPA”, “COACH” or “LAKESIDE”.
3.2 Text we refuse
- Names of professional, semi-professional, college or national teams, leagues and clubs, including their nicknames and abbreviations.
- Names of real athletes, current or retired, including surname-and-number combinations that point to a specific player.
- Brand names, sportswear company names and product names.
- Trademarked slogans, catchphrases and wordmarks.
- Names of characters from films, shows, games or comics.
- Any text describing or imitating a logo, crest or mascot.
- Offensive, hateful or unlawful text.
A personal name that happens to match a famous athlete’s surname is not a problem by itself. If your family name is shared with a well-known player, you may of course print it. Where an order clearly combines a famous surname with that player’s well-known number and a matching colourway, we may ask you about it before production.
| What you type | Our answer | Reason |
|---|---|---|
| Your own surname and the number 07 | Printed as typed | Your own words and number |
| “NANA” with number 60 for a birthday | Printed as typed | Personal nickname |
| Your made-up rec team name on the front | Printed as typed | An original name you created |
| A pro or college team nickname | Declined, full refund | Belongs to that team |
| A famous player’s surname plus their number, with no personal link | We contact you first | Points to a real person’s identity |
| A sportswear brand’s slogan | Declined, full refund | Trademarked phrase |
4. How we check orders
We print exactly what you type and do not send a proof before production, so we read the personalisation text on incoming orders with this policy in mind. If we see text that breaks section 3.2, we email you. Within the 24-hour change window you can replace the text with your own words, and if you would rather not, we cancel the order and refund it in full. If we only notice later, we still will not print text we are not allowed to print; we will contact you and help you sort it out. The details of changing an order are on Cancel or Change an Order, and the refund side is on our Refund Policy.
Repeated attempts to order refused text may lead us to stop accepting orders from that account.
4.1 Matching sets for groups
Group orders are where this rule comes up most. A family ordering six hockey sweaters for a reunion, or friends ordering baseball pullovers for a weekend tournament, often want one shared word on every piece. Pick a word that is yours, such as the family name, the street you grew up on or a team name you invented, and use each person’s own name and number on the back. That keeps the set personal and keeps everyone’s order moving.
5. Other people’s names and marks on this site
We avoid using third-party names on jersa.shop. Where a carrier, payment provider or similar service is mentioned because you need to know about it, its name belongs to its owner and the mention does not mean it endorses Jersa.
6. Respecting people as well as brands
Intellectual property is not only about companies. People have rights in their own name and likeness. We do not use photos of real athletes, and we do not describe products as being “as worn by” anyone. If you feel a page on our site uses your name, image or identity without permission, the reporting route below applies to you too.
7. How rights holders can report a concern
Email support@jersa.shop with the subject line “IP concern” and include:
- Your name and contact details, and how you are connected to the rights owner, for example owner, employee, licensing agent or lawyer.
- The right concerned: a trademark with registration number and country, a registered design, a right of publicity, or another right, described clearly.
- The page address of each product, image or text on jersa.shop you are concerned about.
- A short explanation of why you believe it infringes, and a statement that the information you provide is accurate and that you are authorised to act.
If your concern is copyright in a photo, artwork or text, the DMCA page sets out the formal notice elements. Postal reports can be sent to Jersa, 7508 Crooked Creek Dr SW, Byron Center, MI 49315, US, with an email copy so we see it sooner.
8. What happens after you report
8.1 We acknowledge
You will hear from us within 24 hours on business days. If your report is missing something we need, we ask for it then.
8.2 We review
We look at the listing, the colourway artwork and any customer text involved, and compare it with the right you described.
8.3 We act
Where a concern is well founded, we take the listing offline, change the design or image, or stop accepting the text involved, and tell you what we did. If we disagree, we explain why in writing and remain open to further information.
8.4 Customers who are affected
If an open order uses a design or text that we withdraw, we contact that customer to offer a change or a full refund. Pieces already delivered stay with their owners.
| Your concern | Route | Email subject |
|---|---|---|
| A team, league or brand name or logo | This policy, section 7 | IP concern |
| Your photo, artwork or writing copied | DMCA notice | Copyright notice |
| Your own name or likeness used | This policy, section 7 | IP concern |
| A question about your order | Contact Us | Your order number |
9. Ideas and feedback
Customers often send colourway ideas, like a mint and maroon baseball pullover or a hockey sock in the same stripes as a sweater. We love reading them. If you send an idea, we may use it without payment, and we never publish your name or personal details with it unless you say so.
